Samsung has taken legal actions against JOLED for ‘patent infringement’ in the field of Organic Light Emitting Diode (OLED) which is a main display technology of South Korea.
It is interpreted as a counter-attack lawsuit for JOLED’s patent dispute in the last year.
Heavy weight display companies in Korea and Japan seem to begin wars over next-generation OLED technology.
According to the business industry on the 12th Samsung Display submitted a patent infringement lawsuit against JOLED and ASUS to the Western District Court of Texas on the 8th in local time.
JOLED which is accused of infringing on patent right is one of the leading display companies in Japan and it is an OLED specialized company formed a joint business by the Innovation Network Corporation of Japan (INCJ) which is a public-private fund between the Japanese government and major corporations Japan Display Inc. (JDI) Sony and Panasonic on January 2015. In 2016 JDI took over INCJ’s shares additionally and incorporated into subsidiary company.
Samsung Display claimed through their complaint that the defendants JOLED and ASUS caused tremendous damage by selling the products that infringed their patents in the US market.
According to their claims JOLED infringed its OLED technology patent ‘Thin film transistor array substrate and organic light-emitting diode display including the same (Patent Number 9768240)’ registered in the US Patent Office.
In this respect Samsung Display included ‘ASUS’ in the lawsuit which is Taiwanese electronics company which receives OLED panels from JOLED.
Particularly Samsung Display pointed out ‘ProArt (model name PQ22UC) the 4K UHD OLED panel-based 21.6” monitor released by ASUS in 2018 as a specific product of patent infringement.
According to Samsung Display the offending patent was applied in October 2014 in Korea and then the application examination began in May 2015 in the US.
The patent was officially registered by Samsung Display in the US Patent Office on September 19th in 2017 as a owned patent. However JOLED announced that they had supplied the sample of OLED panels for ‘ProArt’ monitor to ASUS in January 2018 which is about 4 months behind in time.
Samsung said through the complaint that “Please issue a permanent order for the defendants JOLED and ASUS who directly and indirectly invading our patents” and demanded seek damages that Samsung Display suffered.
Samsung Display’s lawsuit against JOLED for patent infringement is analyzed as a counterattack to the dispute between the two companies that came out to the fore since last year.
A while back in June 2020 JOLED filed a patent infringement lawsuit against Samsung Electronics Samsung Electronics U.S. corporation and Samsung Display to the Western District Court of Texas and the District Court of Mannheim Germany.
Some say this lawsuit should be considered as Samsung’s legitimate rights to protect their intellectual property in increasingly competitive OLED display field.
Recently Samsung Display scouted Chang-sik Kim an attorney from the US law firm as an executive in IP of the legal team and this can be seen as a strategy for the coming up patent disputes.
The business industry has shown positive reviews that global company Samsung has actively responded to various patent disputes all over the world.
In this year Ericsson Swedish telecommunications equipment company sued Samsung Electronics for the scale of patent contract loyalties and Samsung Electronics filed a lawsuit to the US International Trade Commission (ITC) claiming the prohibition of the import as a counterattack.
