On February 5th of 2021 China National Intellectual Property Administration (CNIPA) has announced about the consolidating regulations of having patent application.

◆ Main Contents

The main contents of this notification are as followed.

◎ Qualitative improvement in patent application

- By improving the qualities of patent applications given and controlling any irregular deeds in relating to the patent application that are not designated for protecting innovation the Intellectual Property business seeks for modifications on the business style of having qualitative increases other than maintaining old style of focusing on quantitative increase.

- The number and qualities of patent applications must be appropriate for level of regional economy growth industrial development demands and technical innovation capabilities. In addition all kinds of business indicators must be scientifically settled and qualities of guidelines should be consolidated by the relevant departments and organizations in order to play a guiding role for increasing qualitative patents.

- Specified for those 11 kinds of irregular deeds given in relating to the patent application that are not designated for protecting innovation the patent fee is not being reduced for related applicants and cancelling all kinds of related qualifications and actions as the Registered Enterprise Qualification of Intellectual Property Protection Center applying being awarded and having Award Qualification for the China Patent Awards.

◎ Overall cancellation in financial supports

- By the end of June 2021 overall financial supports related to the patent application phase will be fully cancelled.

- During the period of 14th five-year scheme each region must gradually downsize in financial supports for the Patent Rightsization and this supporting action should be stopped by year of 2025.

- It will be mainly focused on the expansion of supporting the management of following modifications protecting administration and public services other than supporting the patent application.
