China National Intellectual Property Administration (CNIPA) establishes action system of an Online dispute resolution system

On December 29th of 2020 with the cooperation of Supreme Peoples Court CNIPA has announced the notification of establishing Online Action System for Intellectual Property Right-related Dispute.

This notification is officially announced for preparing the solution installation of Online Intellectual Property Right-related Dispute which is designated for respecting all thoughts from concerned parties and increasing convenience of high efficiency within low costing.

■Online Lawsuit and Establishment of Arbitration System

CINPA and Supreme Peoples Court establish Online/Offline connected channels for the solution of Intellectual Property Right-related Dispute and guide arbitrators to take advantages of using Supreme Peoples Court arbitrate platforms within providing online services for all arbitration proceedings to be settled.

■Online Arbitration Proceedings

Once a party submits Dispute Conciliation Application to the court through the arbitration platform an arbitrator will be designated by Supreme Peoples Court and the designated arbitrator manages the work inside the platform. In case of disputes are resolved by the arbitration the arbitration agreements will be given when it is signed by relevant parties.

■Consolidate Un-tact Arbitration

All arbitration agencies and arbitrators are required to use of audio or videos via platform for any arbitrate proceedings as all Supreme Peoples Court must be ensured providing online conferences.

■Informatization System Establishment

Each class of Supreme Peoples Court and Intellectual Property Management Department are required to establish the informatization system for both Software and Hardware and enhance to consolidate all data sharing.
