A Lawsuit Filed by American Nursery Rhyme Composer Johnny Only SMARTSTUDY Insists It Is Not a Copyright Infringement as It Is a Traditional Song

The production company of the popular childrens song ‘Shark Family’ (Baby Shark) won the first copyright suit.
The Seoul Central District Court ruled against the plaintiff in a compensation suit on last 23rd filed by U.S. childrens song composer Johnny Only (real name Jonathan Robert Wright) against SMARTSTUDY a Korean company that created Shark Family.
Shark Family is a childrens song produced in 2015 by SMARTSTUDY a startup that produces educational contents. The dance video with the childrens song is gaining huge popularity with more than 9 billion cumulative views on YouTube topping the list.
Johnny Only insisted ‘Baby Shark’ released in 2011 is his remake of a traditional childrens song by giving a unique rhythm to the original and filed a lawsuit in a National Court of Korea in March 2019 claiming that Shark Family plagiarized it. As it was a judgement after more than two years of hearing attention is being paid to whether Johnny Only will accept it.
SMARTSTUDY is taking a stand that Shark Family is produced by arranging a traditional childrens song in North America and has nothing to do with Johnny Onlys work and traditional childrens songs are not recognized for copyright infringement because they do not have copyright.
