On the 22nd Lee Eun-kyung the chief patent attorney of the the a patent company BKL visited Whip News (Reporter Kim Soo-woo) to talk about the recently introduced punitive damages system and those who made efforts to create and revitalize the intellectual property ecosystem.
Q1. Please give us a brief introduction to BKL.
Patent attorney Lee Eun-kyung: I am co-representative of the patent company BKL. We established a separate patent corporation for the intellectual property team just like a subsidiary of BKL law firm. We have about 160 patent attorneys and staff.
Q2. You studied at an American law school but then how did you get interested in intellectual property?
Patent attorney Lee Eun-kyung: My father served as a trademark examiner for the Korean Intellectual Property Office. He entered the patent business and opened a patent office. He told me to prepare for the patent attorney exam when I was in college saying that its a very good job for a woman because I will not encounter discrimination. I was also told that unlike a lawyer I dont need to deal with criminal cases and patent law is closely related to my major in science and technology but until then I wasnt really interested in it. And after I graduated from graduate school and started working at KISIT my advisor suggested getting a patent for my research paper. It was when I first learned about the patent statement in a patent team and got interested in the patent related job. After working in BKL for about 10 years I studied at a law school in America for 3 years. I think Im getting more and more hooked on intellectual property.
Q3. How many countries and people at least do you think need to subscribe to Wip News to name itself the World Intellectual Property Portal?
Patent attorney Lee Eun-kyung: Well first of all it should be an IP5 country. Because there are many countries in Europe I think there should be about 200000 people in about 20 countries.
Q4. What do you think is the greatest intellectual property in the world?
Patent attorney Lee Eun-kyung: While giving a lecture I mention Edisons invention of the light bulb. Thanks to Edison the world is shining brightly. Also Edison was not a businessman so he couldnt make money from the light bulb. But considering that he handed over the license to the electric company and focused on invention which leaded to a virtuous cycle I think Edisons invention is the greatest intellectual property.
Q5. If you own industrial property or copyright please introduce it to us.
Patent attorney Lee Eun-kyung: My research paper in the second question I answered was patented and registered but it was not commercialized. Its a cure for liver disease and I am listed as an inventor of it. After a few years it disappeared because I didnt pay the annual fee.
Q6. Recommend those who have made the best efforts to create and revitalize the intellectual property ecosystem.
Patent attorney Lee Eun-kyung: Kim Myung-shin an adviser to the Patent Society has also served on the Intellectual Property Committee and has made great contributions to the patent industry and the intellectual property industry. He has trained many of his juniors. Another is former Minister Lee Sang-hee. As a patent attorney he ran for a third term as a lawmaker and also served as a chairman of the Patent Society helping the patent industry unite and overhaul its system.
Q7. What is needed for Korea to become an intellectual property powerhouse?
Patent attorney Lee Eun-kyung: I hope it will be a country that protects the patent rights well. To that end I hope that the punitive damages system will be applied properly and that the patentee will be well compensated for the infringement. Businesses and inventors have raised questions about whether or not to get a patent in Korea. I hope that there will be cases where punitive damages are implemented well and that the intellectual property will be well protected.
Q8. What do you think intellectual property is in a word?
Patent attorney Lee Eun-kyung: It is a reward for the creation.
Q9. What is your wish for WipNews that was created to make intellectual property known easily and help Korea become a hub of intellectual property in the world?
Patent attorney Lee Eun-kyung: As far as I know WipNews is the first online intellectual property portal. I think it fits well with future trends so I hope to see it become active and settle down well. We hope it will become a portal site that provides information that the general public can easily understand about their intellectual property. I hope it to develop so that we can see not only news about intellectual property in Korea but also over over the world.
Since its establishment BKL has been engaged in domestic and international applications and registration of intellectual property rights such as patents practical use trademarks and design as well as information provision objection refereeing and appeal litigation and IP-related specialized services such as patent investigation appraisal technology transfer and evaluation and management strategy advice on intellectual property rights.
